ACTIVITIES COVERED: Kayaking, Stand-Up Paddleboarding (SUP), Canoeing, Pedal Boats,
and Inflatable Towables (Banana Boat, Crazy Sofa, Ringo Rides).

1. GENERAL SAFETY & SUPERVISION

Professional Oversight: All activities are conducted under the supervision of specialized professionals
to ensure a safe environment.
Instructions: Participants must be able to clearly understand and follow all verbal instructions from the
staff to safeguard themselves and other guests.
Mandatory Equipment: Lifejackets are mandatory and must be worn securely at all times during the session.

PHYSICAL REQUIREMENTS & CONDUCT

Swimming Ability: Participants acknowledge that these activities take place in open water and confirm
they are competent swimmers.
Physical Exertion: I acknowledge that non-motorized sports require physical effort and confirm I am
in suitable health to participate.
Zero Tolerance: No person under the influence of drugs or alcohol will be permitted to participate.
Loose Items: All jewellery, watches, and cameras must be removed prior to the activity to prevent injury or loss.

TOWABLE-SPECIFIC RULES (Banana / Inflatables)

Group Safety: Participants on towables must follow the signal instructions provided by the tow-vessel captain.
Impact Risk: I acknowledge that towables involve high-speed turns and the possibility of falling into the
water; I confirm I have no neck or back injuries that would be aggravated by such movement.

OPERATIONAL RIGHTS & WEATHER

Weather Policy: Management reserves the right to postpone or cancel sessions due to sea conditions, high
winds, or technical reasons.
Termination: Management may terminate any session without refund if a participant fails to follow safety
terms or behaves in a manner detrimental to others.
Transport Malta Compliance: All participants agree to stay within designated areas and follow the
Transport Malta Notice to Mariners regarding swimmer zones and fairways.

DECLARATION OF CONSENT

I confirm that I have read and understood the terms above. I am responsible for my physical/mental fitness
(and that of any minors I am signing for) to ensure safe participation.

2.WATERSPORTS PARTICIPANT AGREEMENT & LIABILITY RELEASE

ACTIVITIES COVERED: Jet Ski (Rental & Safari), Speedboat Rides, Banana Boat/Towables, Kayaking, and Stand-Up Paddleboarding (SUP).

GENERAL SAFETY RULES (All Activities)

Supervision: All sessions are led by specialized professionals.
Equipment: Lifejackets are mandatory and must be worn properly at all times.
Zero Tolerance: No entry for persons under the influence of drugs or alcohol.
Loose Items: Remove all jewelry and cameras to prevent injury or loss.

MOTORIZED & HEAVY ACTIVITIES (Jet Ski / Speedboat)

Physical Fitness: I confirm I have no heart, back, or neck conditions.
The "Captain's Word": The Captain/Skipper has absolute authority over the vessel and safety.
Operator Responsibility: As a Jet Ski driver, I am solely responsible for my craft, my passenger, and any third-party damages caused by my navigation.

Exertion: I acknowledge these require physical effort and the ability to swim in open water.

Zero Tolerance: No person under the influence of drugs or alcohol will be permitted to participate.

2. ACTIVITY-SPECIFIC RISKS

Motorized (Jet Ski / Speedboat): I acknowledge that these involve high speeds and physical jolting. I confirm I do not have heart conditions or back/neck injuries.
Non-Motorized (Kayak / SUP): I acknowledge these require physical exertion and the ability to swim in open water.

3. OPERATIONAL RIGHTS

Weather: Management reserves the right to postpone or cancel sessions due to sea conditions or technical reasons.
Termination: Management may terminate any session without refund if a participant fails to follow safety terms or behaves detrimentally.

Transport Malta Compliance Clause

LOCAL REGULATION ADHERENCE: All participants agree to strictly adhere to the Transport Malta Notice to Mariners and local maritime laws. This includes, but is not limited to: * Observing all speed limits (especially within the 200m/300m swimmers' zones and bays).

Strict navigation within designated fairways and channels.
Full cooperation with the Armed Forces of Malta (AFM) or Transport Malta officials if hailed. * Immediate cessation of activity if weather conditions exceed safe operating limits as defined by the port authority.

COMMAND & RESPONSIBILITY: The designated Captain/Skipper has absolute authority over the vessel, the route, and the safety of all passengers. "The Captain’s decision regarding weather safety, passenger conduct, and route changes is final and non-negotiable".

JET SKI OPERATOR ACKNOWLEDGMENT: As the operator of the Jet Ski, I acknowledge that I am solely responsible for the safe navigation of the craft and the safety of my passenger.

I agree to maintain a safe distance from other vessels, swimmers, and shorelines at all times. * I understand that I am liable for any damages caused to the craft or third parties resulting from reckless operation or failure to follow the guide’s instructions. * I confirm I have the physical ability and understanding to operate the controls as demonstrated during the pre-departure briefing.

DECLARATION OF CONSENT

I confirm that I have read and understood the terms above. I am responsible for my physical/mental fitness (and that of any minors I am signing for) to ensure safe participation. I agree to abide by all rules whether as: A DRIVER / MAIN PARTICIPANT OR AS A RIDER.

3. PARASAILING PRE-FLIGHT SAFETY GUIDE

1. THE "SIT-BACK" POSITION (Take-Off & Landing)

The Launch: When instructed, sit back into the harness as if sitting in a swing.
Legs & Hands: Keep your legs extended and your hands on the side straps.
DO NOT: Do not attempt to stand up, jump, or run during the take-off.
Landing: Stay in the seated position until your feet touch the deck; the crew will assist your stand-down.

2. FOR THE FLYERS (In the Air)

Stability: Remain calm and enjoy the view.
No Acrobatics: Do not rock the harness or attempt to "steer" the parachute.
Communication: Use the "Thumbs Up" signal to tell the Captain everything is perfect.

3. FOR THE SPECTATORS (On the Boat)

Stay Seated: Passengers must remain in the designated seating area to maintain the boat's balance.
The "No-Go" Zone: Stay at least 2 meters away from the winch and towline at all times.
No Distractions: Do not shout at or distract the Captain during the launch or recovery phase.

4. CAPTAIN'S AUTHORITY

Safety First: The Captain may cancel or shorten flights instantly if wind speeds change.
Weight Check: The Captain decides on Solo/Tandem/Triple flights based on current wind conditions to ensure a stable flight.

Crew Instructions for Briefing:

Show the Gear: Point to the harness and lifejacket while explaining the "Sit-Back" rule.
Point to the Winch: Clearly indicate the "Danger Zone" to spectators before the first flyer gears up.
Confirm Understanding: Ask every participant, "Do you understand that the Captain has the final word on safety?".

PLEASE READ THIS DOCUMENT CAREFULLY. YOUR SIGNATURE OR BOOKING CONFIRMATION CONSTITUTES FULL ACCEPTANCE OF THESE TERMS AND CONDITIONS.

The Experience

This activity offers a unique opportunity to interact with Atlantic Bluefin Tuna at close quarters within a small group. Under the constant supervision of our specialiSed professionals, you will participate in aquatic behaviours designed to be both safe and engaging. This is an excellent opportunity to expand your knowledge about these extraordinary "ambassadors of the oceans". In accordance with international standards governing the handling of marine species, this activity is purely informative to ensure the safety of participants, the fish, and our expert staff.

1. NATURE OF THE ACTIVITY

Environment: This interaction takes place at sea within offshore farm pens. Unlike a controlled pool, this involves high-energy, wild animals in their natural element.
Collaboration: All interactions are collaborative and cannot be forced; the behaviour of the Tuna is not a forced encounter but a mutual one.

2. PARTICIPANT REQUIREMENTS & SAFETY

To ensure the safety of all, guests MUST:

Follow Instructions: Immediately follow all guidance from accompanying divers and swimmers.
Age & Ability: Be at least 8 years of age and a competent swimmer.
Communication: Clearly understand and follow verbal instructions in English (or the guide's language).
Equipment: Wear provided lifejackets or wetsuits at all times. Masks may be used for underwater observation.
Foreign Objects: Remove all loose items (earrings, necklaces, watches, cameras, hair bands, glasses). Note: Tuna are visual predators; shiny objects can be mistaken for bait-fish.
Hygiene: Shower prior to entry; use only "reef-safe" or "marine-safe" sunscreens.

3. PROHIBITED CONDUCT

The following are strictly prohibited under our animal welfare policy:

Any attempt to grab, pull, or "ride" the fish (no fin pulling or dragging).
Excessive splashing, shouting, or behavior that causes stress to the animals.
Close physical contact with the Tuna is to be avoided.
Failure to follow the immediate instructions of safety staff.

4. MEDICAL EXCLUSIONS

For safety reasons, the following cannot participate:

Children under 8, pregnant women, and persons with heart conditions, skin disorders, or hydrophobia.
Persons under the influence of drugs or alcohol.
Anyone whose physical or mental condition limits their ability to follow safety instructions.

5. CANCELLATIONS, REFUNDS, AND RIGHTS

Arrival: Participants must be at the meeting point 10 minutes prior to departure. Late arrivals or early exits are non-refundable.
Cancellations: We reserve the right to reschedule due to sea conditions or technical/biological reasons. If rescheduling is impossible, a refund will be issued.
Removal: Management may terminate a session without refund if safety terms are breached.
Media: We reserve the right to use photos/videos taken by staff for marketing purposes.
